I posed the question of copyright to a contact at NI, here is the response.
"Regarding the copyright question, I would have thought that the copyright should stay with you, the idea of this type of thing is to encourage the use of LabVIEW as an open platform and not to accumulate code written by customers to claim as our own. I understand the concern though especially given some of the news lately on how Facebook deals with this type of thing so I'm double checking the fine print for you. I'll let you know when I've found out more."
He also said he would attend the next user group meeting to discuss licensing.
